I have never pursued litigation but I read somewhere that stuttering was not considered a disability. I had read this years ago and was trying to find the source when I found this: http://www.stutterlaw.com/adaaa.htm This site appears to be a law firm but it still has a lot of interesting information. It appears that in the broad sense that stuttering could be considered a disability. Cases have been filed along these lines but none have been successful. You could be the first one!
